TV scenarios
Feb. 12th, 2004 01:29 pm(Yeah, I know, I posted this to gtg already, but I'm bored and legitimately curious and this would get me more opinions):
1) I guess the laws vary from state to state, but I would think if you were illegally racing someone, and they die, you would be liable for murder or manslaughter in many places even if the guy had planted a bomb in your car. I mean, many places would nail you if you were just driving recklessly and plowed into some innocent pedestrian or other car. I don't think the fact that they chose to race you makes any difference, because their reckless driving is tied in with your own.
2) Let's say a girl has some heart condition and is quickly brought to the hospital and will die if she doesn't have a heart transplant immediately. Coincedentally, her father is fatally stabbed at a nearby ATM and is brought in. He dies, but his heart is okay. The doctors can just give his heart to her without anyone's permission?! If its just them two, I can see it as fine. But if they have a wife/mother around, shouldn't they need her ok? I mean, let's say they were strangers. I don't think a doctor could just give someone else's organs away just because they're a perfect match. I would think they'd go to the family first and ask permission. So conversely, even if they are related, I don't think the doctors can assume that the family would just be all right with it.
